Interesting Dog Bite Case Settled
“The 2nd District has has ruled in favor of an Ogden woman in a lawsuit over a severe dog bite.finding that plaintiff was owed $250,000 in damages from defendants for injuries she sustained in the July 2012 attack.
The Standard-Examiner of Ogden reports the Plaintiff was visiting the couple’s home when their Rottweiler burst into the living room and bit her thigh. It took several minutes for the owners to make the dog let go.”
This is an interesting case for a couple of reasons: 1) It does not appear that the Defendants have homeowners insurance as their insurance company would typically pay for these types of cases; 2) If they did not have insurance, the first question I would ask is ‘how much money/ assets do they have as they will likely file bankruptcy if the answer is little to none.
The $250,000 settlement seems to be a reasonable settlement for a case. Its uncertain the on-going damages. I’m sure that was a big part of the trial. That said, I’m assuming the loss of use wasn’t that large as a loss of a limb would have likely led to a much larger settlement amount.
Some tips for preventing such a case:
Be a responsible dog owner:
- Keep your dog on a leash when outside.
- Train your dog to obey basic commands.
- Exercise your dog appropriately, keep it healthy and vaccinated.
- Don’t put your dog in situations where it might be prone to bite.
